What this service covers
This service relates to complex immigration situations, including opposition from Immigration New Zealand (INZ), unlawful status, medical or character concerns, visa declines, and potential deportation.
It also includes appeals to the Immigration and Protection Tribunal (IPT), Section 61 requests, reconsiderations, special directions, and applications requiring medical or character waivers. Since beginning practice in 2019, every Section 61 request and medical or character waiver I have prepared has been approved.
Who this is for
This service may be suitable if you:
-
Have received a visa decline
-
Are facing medical or character concerns raised by INZ
-
Are in New Zealand unlawfully or at risk of deportation
-
Have received a Deportation Liability Notice or Deportation Order
-
Need to appeal a residence decision to the IPT
-
Require a waiver to proceed with your application
These situations are often time-sensitive and require careful, accurate legal advice.
Common concerns
Clients in these circumstances are often concerned about:
-
Whether they can regularise their immigration status
-
The risk of deportation
-
Whether an appeal or reconsideration is possible
-
How medical or character issues may affect their eligibility
-
Whether there is any realistic pathway forward
Each case is highly fact-specific and requires a structured and realistic assessment.
How the process works
If your application is opposed, declined, or your status has become unlawful, the appropriate pathway will depend on your specific circumstances.
This may involve:
-
Regularising your immigration status
-
Submitting a Section 61 request
-
Filing a request for reconsideration after a decline
-
Seeking a special direction under the Immigration Act
-
Preparing an appeal to the Immigration and Protection Tribunal
-
Addressing medical or character concerns through waiver requests
For clients who are unlawfully in New Zealand, a Section 61 request may be required. This is a request to the Minister of Immigration, who holds broad discretion to grant a visa under this section of the Immigration Act. In urgent situations, these requests can be prepared and submitted quickly.
Where a visa has been declined, a reconsideration request may be appropriate if relevant information was not previously considered or new material circumstances have arisen. In more exceptional cases, a request for a special direction may be made under the Immigration Act.

How I provide support
I specialise in resolving difficult and sensitive immigration situations that require diligence, careful legal reasoning, and effective advocacy.
I assess your circumstances against current immigration law and policy, advise you honestly on realistic options, and prepare detailed submissions where discretion is involved. This includes Section 61 requests, waiver submissions, reconsiderations, and appeals.
Where medical or character issues arise, I can advise on whether a waiver is viable, whether further evidence is required, or whether an alternative immigration strategy should be considered.
Next steps
If you are experiencing immigration difficulties or have received an unfavourable decision from INZ, it is important to seek advice promptly.
An initial consultation allows me to review your situation, identify any available legal pathways, and advise you clearly on the risks, options, and likely next steps.
